The calculation of paid holiday can be an extremely complex area of law. Occasionally the European Working Time Directive can conflict with domestic law (Working Time Regulations). In addition, the last few years has seen a significant increase in cases analysing worker rights in relation to holiday pay and how this is calculated.
We can assist with calculation and interpretation of holiday clauses and also advise on daily and weekly rest periods, holiday and sick leave issues and unfair notification requirements imposed by employers.
The law surrounding how working time is measured and its correlation with the requirements of NMW has also been the subject of recent decisions and often, further clarity is needed. We can assist if you consider that your working practices are such that you are not receiving adequate breaks or being paid properly for your working time.
