    Elaine Strachan

    Barrister and Head of Family

Law is in my DNA. I find the challenge and intellectual stimulation of work, a joy. Securing the best outcome for a client is the finest reward a barrister can achieve.

A barrister, called to the bar in 1995, I read Law at Kings College, Cambridge University. I was awarded a Scholarship from the Middle Temple and immediately following qualification, practised from a London-based set of Chambers, where I developed a specialist practice in private family law.

My areas of expertise include matrimonial finance, dissolution of civil partnerships, Trusts of Land and Appointment of Trustees Act applications, applications under Schedule 1 of the Children Act, and all aspects of private children law.

I have extensive experience of cases involving high net worth individuals and complex assets including companies, partnerships, shareholdings and investments, multiple real properties, development property, assets beyond the jurisdiction and family trusts.

I provide advisory services, drafting of legal documents (nuptial agreements, cohabitation agreements, pleadings, consent orders and the like) and I am a trained advocate. Throughout my career, I have routinely represented clients at First Appointments, FDR’s and Final Hearings. Cases have ranged from the County Court, High Court to the Court of Appeal.

It is my view that where practicable, litigation and contested proceedings ought to be avoided. I am skilled in negotiations. I have considerable experience of representing clients at mediation appointments and joint settlement meetings.

Whilst I am conscientious in giving realistic advice and achieving settlement wherever possible, when matters cannot be resolved by consent, I am steadfast and determined, both in advocacy and the advancement of a case.

As to law generally, I enjoy keeping abreast of developments and providing training. I present seminars both in-house and on an external basis. I also provide lectures, upon invitation, at Oxford University.

I am a member of Resolution, the Family Law Bar Association and the Honourable Society of the Middle Temple.
